Making your will legally binding

What is legally binding

A signed, witnessed will that meets your state's formal requirements is legally binding. The Will IQ draft becomes legally effective the moment you (the testator) sign it correctly with witnesses present.

Until then, the draft is preparation — clear, organized, and ready for execution.

What requires witnesses

Almost every U.S. state requires two competent adult witnesseswho watch you sign and then sign themselves. Witnesses must:

  • Be 18+ and of sound mind.
  • Not be named as beneficiaries in the will.
  • Be physically present (most states require in-person; a few allow remote with audio/video).

What requires notarization

The will itself usually does not need notarization. The self-proving affidavit attached to your will does, and it dramatically speeds up probate later. A few states (e.g. Louisiana) require notarization for the will itself.

What varies by state

State law controls execution. Common differences:

  • Witness count & eligibility (most states: 2 disinterested adults).

  • Self-proving affidavit format — wording differs by jurisdiction.
  • Community-property rules in AZ, CA, ID, LA, NV, NM, TX, WA, WI.

Your signing checklist

  2. 2Review the draft carefully — every page, every name, every percentage.
  3. 3Print the document (use the Export Center) and gather two adult witnesses who are not beneficiaries.
  4. 4Sign in the presence of both witnesses; they sign immediately after.
  5. 5If your state allows it, have a notary acknowledge the self-proving affidavit at the same session.
  6. 6Store the signed original somewhere safe; give a copy and the location to your executor.
